TD calls for “army” to assist gardai police Limerick town following…

first_imgLinkedin TAGSKeeping Limerick PostedlimerickLimerick Post Limerick Ladies National Football League opener to be streamed live Email Facebook Twitter A Limerick TD has called for the Defence Forces to assist gardai police the town of Rathkeale over forthcoming Christmas and New Year periods, following a number of alleged incidents in the town over the recent festive holidays. The call, made by Independent TD Richard O’Donoghue, came as gardai began an investigation into a bare knuckle fight which occurred in the town last Monday.Sign up for the weekly Limerick Post newsletter Sign Up Videos showing a vicious fight in the town centre were shared online this Wednesday. The video shows a large group of men and women jeering and shouting at one another, as two bare-chested males fight one another. An older looking man, who is fully dressed, appears to be covered in blood around his face and neck.Gardai said last week that they had enough resources to deal with a surge of between 1,000 – 2,000 visitors to the town over Christmas. However, Deputy O’Donoghue said: “The gardai in the district go above and beyond what they have to do, but they don’t have the resources for Rathkeale (at Christmas) because they are covering the whole district. The problem is an influx of people coming into Rathkeale destroys everything in the town, and people stop coming in because of the traffic congestion, anti social behaviour, caused by a minority of people that come to Rathkeale.”“They are destroying a perfectly good town and a vibrant business town by people who come in every Christmas.”“The Council every year spends two or three meetings discussing what policing issues are we going to have in place in Rathkeale come Christmas – that’s not right, we shouldn’t have to have a situation where we have to have meetings with the gardai to discuss one town, because of the influx of people coming in from the UK and other places who are destroying a beautiful town.”“We don’t need extra garda resources for Kilmallock or Adare – it’s only for one town and this has to stop.”“Bring in the army to help, yes the army aren’t able to make arrests, but they can be there as a presence. We need to make sure that when that minority come home for Christmas that they behave.”“The army could help with garda checkpoints, they could be on the street to see this for themselves, gather information for the gardai, find out where the anti-social behaviour is… we have fights on the streets in the middle of the day.”“We need to make Rathkeale – at Christmas time – safe again for everyone, to encourage people in and support the businesses all year round.”Deputy O’Donoghue said he was not referring to local families, “that have been there for generations, that have integrated in the community, and have supported businesses in the community”.“I am talking about a minority of people that come and cause it — we don’t have this trouble all year round, we only have it at Christmas time”.“These people are not from Rathkeale, or Ireland, and they come in and try to use Rathkeale as an anti-social party town, which it is not, and we need to stop that.”Rathkeale Community Council said that Rathkeale had one of the lowest crime rates in the Newcastle West Garda District and it has been unfairly targeted. However, a informed local source, who said they did not wish to be identified for fear of reprisals, said those involved in Monday’s melee in the town “behaved like animals”.“They boxed the head off of one another, held up traffic, people were frightened out of their lives, people were inside in cars and they couldn’t get up and down the Main Street, it was like a boxing ring.”“Rathkeale was a jungle again this Christmas, and anyone who says different is sticking their heads in the sand,” they added.A garda spokesman said: “Gardaí responded to reports of an assault in Rathkeale town square on Monday, January 4th 2021. One male, aged in his forties, was conveyed to Limerick Hospital for treatment for his injuries and has since been released and returned home.”They added: “One male has been arrested and charged in relation and is due to appear before Newcastle West District Court on the 8th of January 2021.”A number of house parties and flouting of mask wearing and social distancing alleged to have taken place in Rathkeale over Christmas are also under investigation after videos were shared online. On December 28th, Gardai confirmed they were preparing files for the DPP “following incidents encountered by Gardai in Rathkeale across the Christmas period involving gatherings by large groups at private establishments and on public thoroughfares in the town.”When asked about garda resources in Rathkeale, a spokesman replied: “A local Garda Operation commenced on Tuesday, 24th November, 2020, and remains in place in the Rathkeale area. Sufficient Garda resources are currently in place for the area.”“Any breaches of COVID-19 restrictions will be investigated by Gardaí and a file will be prepared for the Director of Public Prosecutions in each case.”When asked about crime in the town over the festive period, another garda spokesman replied: “The number of burglaries, assaults, and public order incidents in recent weeks are down when compared to other years”. COA Reverses Child Support Modification Despite Untimely Appeal

first_imgCOA Reverses Child Support Modification Despite Untimely AppealOlivia Covington for www.theindianalawyer.comDespite a father’s untimely filing of an appeal, the Indiana Court of Appeals decided to reverse a child custody modification order, finding there was an “extraordinarily compelling reason” to consider the father’s case on its merits. In Charles Cannon v. Kristy A. Caldwell, 89A01-1607-DR-1643, Kristy Caldwell was granted custody of her two children with Charles Cannon, who was ordered to pay $20 per week in child support. Additionally, the children received a monthly derivative benefit of $93 each from Cannon’s Social Security Disability, for a total of $266 per month. However, when Cannon became ineligible for SSD and began receiving Social Security Income of $773 per month instead, the children stopped receiving derivative benefits, so Caldwell filed a motion to modify child support. The Wayne Superior Court subsequently modified Cannon’s child support obligation to $35 per week on May 27, 2016, then denied his motion to reconsider on June 29.Then on July 21, Cannon filed a notice of appeal. On appeal, he argued that the trial court erred in ordering him to pay child support because SSI does not constitute income for purposes of calculating child support obligations.Indiana Court of Appeals Judge Terry Crone initially noted in a Thursday opinion that although Cannon filed a motion to reconsider on June 2016, the 30-day window for a notice of appeal began when the child support order was modified on May 27. Thus, his July 21 notice of appeal was untimely. However, Crone further wrote there was an “extraordinarily compelling reason” to consider Cannon’s untimely appeal on its merits – the “obvious injustice” of using Cannon’s SSI to modify the child support order.“(The) Indiana Child Support guidelines specifically provide that means-tested public assistance programs, including SSI, are excluded from the definition of weekly gross income used to determine a parent’s child support obligation,” the judge wrote.  “… Thus, the child support modification order setting Father’s child support at $35 per week is on its face in clear violation of Child Support Guidelines.”The case was remanded for the reversal of the child support modification order.FacebookTwitterCopy LinkEmailSharelast_img read more

Alastair Cook bemoans weakened spin options in Mumbai loss

first_imgEngland no longer have the world class spin options available to them that they enjoyed when they stunned India in 2012, captain Alastair Cook said after his side fell 3-0 behind the hosts in the five-match series on Monday.England are the last team to win a series in India when they beat the hosts 2-1 four years ago with spinners Graeme Swann and Monty Panesar revelling in the conditions, and ably supported by prolific wicket-taking paceman James Anderson. (Also read: Virat Kohli takes a dig at England batsmen after James Anderson’s controversial remark)During that series, Panesar took 11 wickets at the Wankhede Stadium while Swann picked up eight more to help England thrash India by 10 wickets. However, leg-spinner Adil Rashid, who is England’s highest wicket-taker in the ongoing series with 22 victims, and off-spinner Moeen Ali have failed to match those performances.”No disrespect to Mo and Rash but Graeme Swann and Monty Panesar were world class bowlers in 2012,” Cook told reporters after England’s defeat by an innings and 36 runs. “In these conditions you need that. (Also read: Mumbai Test: Virat Kohli 235, R Ashwin 12/167 give India historic series win over England)”Mo and Rash have bowled well but they are not yet in that league…I do not mean that disrespectfully at all and that is why we need a slightly different balance to the side.”In 2012, we could play the four bowlers, two seamers and two spinners, but in this side we need more options.”Cook admitted England had erred by picking an extra seamer in Jake Ball while overlooking Gareth Batty as the pitch had nothing in it for the quicker bowlers.advertisement”Here we knew it was going to spin,” Cook said. “But one thing we have strength in depth in is our seamers and we can get control with our seamers if it is not spinning a huge amount.”Generally here in Mumbai it spins slightly later on in the game but it spun pretty much from ball one and last time in 2012 it didn’t and the pitch looked exactly the same.”Cook was also left to rue England’s failure to take the chances that came their way. (Also read: Beating England not as easy as it looked: Virat Kohli)Jonny Bairstow missed a stumping opportunity of Murali Vijay on 45, while Rashid dropped a difficult return catch from India captain Virat Kohli on 68 and Joe Root also put down Jayant Yadav at slip on eight.Vijay scored 136, Kohli went on to make 235 and Yadav 104.”We missed three good chances to take wickets and they made us pay,” Cook said. “Missing Kohli, missing Vijay and Yadav cost us dearly.”It is just frustrating. To beat India in these conditions you have to play the perfect game and we haven’t managed to do that.”last_img read more
